Musician who helped Abigail Breslin is now suing

Abigail Breslin is one of America's sweethearts. As a child actress in "Little Miss Sunshine," she was Oscar nominated. Now she stars in FOX's new show "Scream Queens".

Her career may be blowing up, but musician Sean Brody is suing her alleging she made him work, for free.

Brody is part of a local band called "The Weekenders".  He says getting the opportunity to work with Breslin was a dream come true for him.

"It felt like a big opportunity for a small time kid. I've been working my whole entire life for this. So when I got the call it was really exciting. I was ecstatic. All my buddies were ecstatic in my band. Even meeting her was great," said Brody.

Brody says his job was to help Breslin with her unreleased album. 

"We were simply just musicians that were going to play the album live for her. So this music was written with her producer I assume and they just brought it to us and said 'hey this is the music that you're gonna play. Learn it and play it' so that's what I did," said Brody.

Brody saw the dream, but never actually signed a contract with Breslin or her manager. He says since then, he was never paid a cent.

"We never came to a complete agreement on the dollar amount. We had said between $35 and $50 an hour. Money is a tough thing to talk about especially when you have none of it and you're working with such a prominent figure in the industry," said Brody.

Breslin is worth an estimated $12 million. Brody is suing her for $2,125.

Breslin's attorney, Linda Lichter, declined to comment.

Brody is scheduled to appear before a judge on December 10, 2015. In the meantime he continues to play with his band.
