Child Injured On School Bus Did Not Have Seatbelt

A mother says her 6-year old son with autism was hurt on his school bus because he wasn't buckled in. He can't do it himself and his mom says the bus aide won't do it for him.

Somebody dropped the ball. The Philadelphia School District admitted that a 6-year-old-boy with special needs should have been buckled into a seat belt, but that never happened and now the first grader is recovering at home with 2 staples in his head.

Devon Jankowski is a huge fan of superheroes. His current favorite is Ironman.

Devon also loves his teacher and friends in first grade at Laura H. Carnell Elementary School, He hasn't been to school since last Thursday when his bus stopped short and he went flying, leaving him with 2 large staples in his head.

"I ran onto the bus and he was gushing blood it was really bad he was screaming it was horrible," Deborah Jankowski said. "I just wanted to keep my kids safe, Accidents happen I understand that but this accident was the result of him not wearing a seatbelt. Just put the seatbelt on him. That's all I'm asking."

A copy of Devon's education plan states the autistic first grader needs to be buckled in because he can't do it himself, but even after the accident the bus driver told mom he didn't have that paperwork.

So she had the school send it to the bus company again, but she says she was told no one could help for 7 to 10 days.

"I trusted them. I put my child in their trust to keep him safe. They failed to do that and whether it was a miscommunication between the school or them not having the right paperwork, let's just fix it now. He needs to be in a seatbelt. Why are they fighting me on this, " Deborah asked.

The Philadelphia School District agrees.

"The education plan for the child did state that the child needed to be buckled up and he was not buckled up," Fernando Gallard, a Philly Public Schools Spokesman said.

 Spokesman Fernando Gallard says there wasn't even a seatbelt on the bus for Devon until they installed a new one yesterday. He promised that Devon will be belted in if his mom choses to send him back to school tomorrow.

Devon's mom tells us he'll return to school tomorrow, and she'll be watching to make sure he's buckled in.
