And in the era of social media, you may just want to think twice before letting loose in front of your coworkers this holiday season.
Attorney Heather Hansen was on Good Day to explain office party etiquette.
If you get boozed up at the workplace, and then your coworker takes a picture of you and uploads it onto social media, you cannot sue her.
"It's all about a reasonable expectation of privacy," said Hansen. Therefore, if you are in a private bedroom trying to sleep off the eggnog, then maybe you have some claims if your picture ends up on social media. "You have no reasonable expectation of privacy out in public that your picture won't be taken."
And even more, you don't have copyright to your own photo. Instead, the person who took the photo has the copyright.
"They are public forums. You have no expectation of privacy there," emphasized Attorney Hansen.
If you serve alcohol at a party that you're hosting, you want to take steps to protect yourself in case one of your coworkers has a tendency to over-indulge. Hansen recommends taking advantage of a bartender to have a gate person. Another way is to give drink tickets to limit everyone's consumption of alcohol.
If you want to give a gift during the holidays, make sure to stick with homemade gifts or food. If you're giving your coworker something risqué, make sure to give it outside of the party and work hours.
If you're an employee, make sure to review the sexual harassment policies of the company. We all know flirtations happen in parties; therefore, make sure to know what your company can do in case a misunderstanding happens.
In general, make sure to err on the side of caution, says Attorney Hansen.
