Dads In The Delivery Room Debate Continues

Trenton, New Jersey (My9NJ) - On Friday social media was buzzing after a judge’s ruling would allow unwed mothers to ban fathers from the delivery room during the birth of their child if she chooses.

However, this ruling may not be as cut-and-dry as some people think. In one case Anthony Benenato sued his expecting ex-girlfriend who did not want him in the delivery room during the birth of their son. After the judge heard his case he was granted an emergency injunction and allowed in the delivery room. Benenato said that it cost him thousands of dollars but it was all worth it.

“I had to do it because I know it’s the right thing to do and I helped create a child and this is what I had to do,” he explained.

In this particular case, the judge ruled that because there was a paternity test, so there was no question as to whether or not Benenato was the father, he had every right to witness the birth of his child.

After many thought that this law was clear, it appears that there are still some gray areas and a judge’s ruling is determined more on a case by case basis.
