New York Supreme Court Judge Barbara Jaffe has denied the appeal of Kristina and Douglas Panattieri to release their 80-pound pit bull, Caesar, who has been on death row since May for attacking and killing a Chihuahua on Staten Island.

The Panattieris were fighting for his release on the grounds that the city's procedures did not match New York state's regulations in handling a dog involved in an attack.

The couple's lawyer, Richard Rosenthal, said he believes there was no in-depth analysis of the statute or the law in the judgment and that they are appealing the ruling.
